Attorney appointed for Caleb Flynn in appeal

Attorney appointed for Caleb Flynn in appeal of life-without-parole sentence

Caleb Flynn has been appointed an attorney to represent him in his appeal after being found guilty of killing his wife.

According to court documents filed Thursday, October 15, Jacob Seidl will represent Flynn on appeal.

Court documents specify that the attorney is for this appeal only, not for post-conviction or other court proceedings.

Flynn is going through the appeal process to reverse the “judgment rendered against him on October 6, 2026," which includes being found guilty of Aggravated Murder, Murder, and Tampering with Evidence.

Flynn was then sentenced to life without parole.

This appeal will take place while Flynn is in prison. If he wins, he would be released from prison. If he doesn't, he'll just continue serving his sentence. He could take the appeal to the U.S. Supreme Court, and if he loses there, that will end the process.

How the Ohio criminal appeal process works

These steps apply to Flynn’s case because he is pursuing a direct appeal:

Notice of Appeal

Must be filed within 30 days of sentencing. This triggers the appeal. Flynn’s notice was filed on October 7.

Record Preparation

The clerk and court reporter prepare:

• Trial transcripts

• Exhibits

• All filings are sent to the Court of Appeals.

Briefing

• Flynn’s appellate attorney files an opening brief explaining alleged legal errors.

• The State files its answering brief.

• Flynn may file a reply brief.

Oral Argument (optional)

The appeals court may schedule oral arguments, but it’s not guaranteed

Decision by the Appeals Court

A three judge panel can:

• Affirm the conviction

• Reverse the conviction

• Modify the judgment

• Remand the case for a new trial or further proceedings

Further Review

If Flynn loses:

• He can request reconsideration in the Court of Appeals.

• He can ask the Ohio Supreme Court to accept the case (discretionary).

• He could even petition the U.S. Supreme Court, though acceptance is rare.

Important notes about appeals

• An appeal does not retry the case or introduce new evidence. It only reviews the trial record for legal errors.

• Flynn will remain in prison during the appeal. If he wins, he could be released or retried; if he loses, he continues serving his sentence.

Why a new attorney

Ohio requires different qualifications for trial vs. appeal attorneys

Ohio’s appointed counsel system uses rotating appointment lists and qualification tiers. Attorneys must meet specific training requirements depending on the type of case they’re appointed to. The rules require courts to match attorneys to cases based on their qualifications and experience.

Appeals often require:

• Specialized appellate training

• Experience writing appellate briefs

• Knowledge of appellate standards of review

Not all trial attorneys meet those appellate qualifications, so the court appoints someone who does.

Appeals are a completely different skill set

Trial work = witnesses, evidence, objections, jury strategy. Appeals = legal research, transcript review, writing briefs, identifying legal errors.

Many trial lawyers don't handle appeals, and many appellate lawyers don't try cases. Courts routinely appoint a separate attorney who specializes in appeals.

Conflict of interest rules

One of the biggest reasons:

An appeal often argues that trial counsel made mistakes (e.g., didn’t object, didn’t request a venue change, didn’t challenge jury instructions). Your trial lawyer cannot ethically argue their own errors. That creates a conflict of interest.

So the court appoints new counsel who can:

• Review the trial objectively

• Raise issues involving trial counsel’s performance if needed

• Challenge decisions made during trial without conflict

This is standard in Ohio and nationwide.
