A Tipp City man convicted of possessing child pornography was sentenced Monday to four years in prison.
Michael Canode, 46, of North Fourth Street was arrested initially on nine felony charges of pandering sexually oriented matter involving a minor, pandering obscenity and illegal use of a minor in nudity oriented material or performance.
He later was indicted by a Miami County grand jury on 12 counts of pandering sexually oriented matter involving a minor.
Tipp City and Troy police executed a search warrant at Canode’s home on Aug. 16 after a Troy police detective notified Tipp City police of suspected child pornography downloaded on a computer. Several items used to store digital media and two computers were seized.
Canode pleaded no contest and was found guilty of the 12 counts in December in Common Pleas Court, where Judge Christopher Gee sentenced him.
Defense lawyer Steve King asked the judge to consider that Canode had virtually no criminal record.
Canode declined to speak.
Gee told Canode that the images he was charged with downloading were the result of children being exploited for sexual purposes.
“You are part of that exploitation,” Gee said. “You are, by virtue of being someone who downloads this ungodly material, making it possible for that marketplace to exit.”
Canode will be required to complete five years of post-prison release control and to pay court costs associated with his conviction.
He was designated at Tier II sex offender, which will require him to register his address with the sheriff in the county where he lives, works and/or goes to school for 25 years following prison release.
